TERMS OF SERVICE

Welcome to Goldenberg Fit. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "you", "your"), and Golden Sport, LLC, a legal entity registered under the laws of the Republic of Kazakhstan, having its registered office at: 46 Makatayeva Street, Apt. 57, Medeu District, Almaty, Republic of Kazakhstan ("Company", "we", "us", "our").

By accessing or using our website, purchasing our 14-day online fitness course, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using our services and must discontinue use immediately.

1. ELIGIBILITY AND USER REPRESENTATIONS

1.1. By purchasing our products or registering an account, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding contract under the laws of your jurisdiction.

1.2. You represent and warrant that all registration and purchase information you submit is truthful, accurate, current, and complete.

1.3. You agree that your use of our services does not violate any applicable law or regulation in your country of residence.

2. SERVICES AND DELIVERY OF DIGITAL CONTENT

2.1. The Company provides a 14-day online fitness course consisting of pre-recorded video materials, instructional guides, and text lessons (the "Product", "Course").

2.2. Upon successful completion of a one-time payment, the system automatically generates access credentials or a direct link to the digital content.

2.3. This delivery information is immediately dispatched to the email address provided by the User during the checkout process.

2.4. Subject to compliance with these Terms, the User is granted lifetime access to the purchased Course.

2.5. "Lifetime access" refers to the lifespan of the Product's availability on our platform. The Company guarantees that the content will remain accessible for as long as the Company continues to commercially operate the specific Course platform.

3. FEES, PAYMENT TERMS, AND NO UPSELLS

3.1. All transactions are processed securely through our designated third-party Merchant of Record (Lemon Squeezy) or alternative authorized payment processors.

3.2. Access to the Course requires a one-time, flat-fee payment. There are no recurring fees, subscription obligations, or hidden maintenance costs associated with this purchase.

3.3. The Company explicitly states that there are no additional in-course purchases, cross-sells, or required upgrades needed to fully access and complete the 14-day fitness program.

4. REFUND AND CANCELLATION POLICY

4.1. Due to the digital nature of the Product, the Company operates a conditional refund policy to maintain a fair balance of interests.

4.2. Users are eligible to request a full or partial refund within fourteen (14) calendar days from the date of purchase.

4.3. A refund is only permissible provided that the User has not opened, viewed, or downloaded more than twenty percent (20%) of the total materials, modules, or lessons available in the Course.

4.4. Compliance with the refund criteria is evaluated automatically based on the platform's user-activity logs and data tracking analytics.

4.5. To request a refund, please contact our support team via email at support@goldenbergfit.com with your order details and purchase confirmation.

4.6. Refund requests submitted after the 14-day period or failing to meet the 20% consumption threshold will be rejected. Approved refunds will be processed back to the original method of payment.

5. MEDICAL AND HEALTH DISCLAIMER

5.1. NO MEDICAL ADVICE. The content, training programs, exercise demonstrations, nutritional suggestions, and informational materials provided within the Course are for educational, motivational, and general reference purposes only. They do not constitute medical advice, diagnosis, or treatment.

5.2. ASSUMPTION OF RISK. Physical exercise and fitness routines carry an inherent risk of injury. By participating in the Course, you acknowledge that you are voluntarily performing physical activities and expressly assume all risk of injury, illness, or medical complications.

5.3. CONSULTATION WITH A PHYSICIAN. You are strongly advised to consult with a qualified healthcare professional or physician before starting any new physical fitness program, especially if you have pre-existing medical conditions, injuries, or cardiovascular risks.

5.4. LIABILITY EXCLUSION. The Company, its founders (Kardanov Tamerlan Alimovich, Selina Alika Olegovna), and employees are not liable for any health problems, physical injuries, or medical conditions resulting from your implementation of the training programs provided in the Course.

6. INTELLECTUAL PROPERTY RIGHTS AND RESTRICTIONS

6.1. Unless otherwise indicated, the website and the Course materials—including but not limited to videos, texts, source code, databases, functionality, software, website designs, audio, graphics, and charts (collectively, the "Content")—are owned or licensed by Golden Sport, LLC, and are protected by copyright, trademark, and other intellectual property laws.

6.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Content solely for your personal, non-commercial use.

6.3. PROHIBITED ACTIONS. You are strictly prohibited from copying, distributing, reproducing, publishing, or selling any part of the Content.

6.4. You are strictly prohibited from recording, ripping, or capturing the screen during video playback of the Course.

6.5. You are strictly prohibited from sharing, leasing, or transferring your personal account credentials (username and password) to any third party.

6.6. Any unauthorized use or sharing of account access will result in the immediate termination of your access to the platform without a refund, and the Company reserves the right to pursue statutory legal damages for copyright infringement.

7. LIMITATION OF LIABILITY

7.1. In no event shall Golden Sport, LLC, its directors, officers, shareholders (including Kardanov Tamerlan Alimovich and Selina Alika Olegovna), or employees be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the website or the digital content.

7.2. The services are provided on an "AS-IS" and "AS-AVAILABLE" basis. The Company makes no warranties that the service will be uninterrupted, timely, secure, or completely error-free.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1. These Terms and your use of the services are governed by and construed in accordance with the substantive laws of the Republic of Kazakhstan, without regard to its conflict of law principles.

8.2. Any dispute, controversy, or claim arising out of or relating to this Agreement, including its formation, validity, or termination, shall first attempt to be resolved through amicable, good-faith negotiations between the parties within thirty (30) days of written notice.

8.3. If a resolution cannot be reached through negotiation, the dispute shall be submitted to and finally resolved by the competent courts located in Almaty, Republic of Kazakhstan.

9. MODIFICATIONS AND AMENDMENTS

9.1. The Company reserves the right, in its sole discretion, to modify, update, or replace these Terms at any time.

9.2. The "Last Updated" date at the top of this document will reflect the date of the most recent changes. Your continued use of the platform after the publication of changes signifies your formal acceptance of the updated Terms.
